TERMS AND CONDITIONS

1. About us and these terms

This website is operated by Wonderium World, ABN 13 768 069 008, based in Melbourne, Victoria. The site is hosted by Shopify.

In these terms, "we", "us" and "our" means Wonderium World. "You" and "your" means you, our customer or website visitor.

These terms apply every time you use this website or place an order with us. By using the site or ordering from us, you accept them. Please read them before you order.

If you're buying as a business, including a childcare centre, school, clinic or retailer, additional trade terms may apply and will be provided to you separately. Where those trade terms conflict with these, the trade terms apply.

2. Using our website

You agree to use this site lawfully and not to interfere with it, attempt to gain unauthorised access to it, or use it in a way that damages or disrupts it for anyone else.

We do our best to keep the site available and accurate, but we can't guarantee it will always be uninterrupted or error free.

3. Our products

We take care to describe and photograph our products accurately.

Colours may look slightly different on your screen depending on your device and its settings, and printed colours can vary a little from what you see online. Small variations in print, finish or trim between individual mats are normal and aren't considered a fault.

Our mats are designed and printed in Australia.

We may change, discontinue or update products, designs and pricing at any time. Any change applies to future orders only and never to an order you've already placed and paid for.

4. Orders

Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation.

We may decline or cancel an order before it's dispatched, including where the item is unavailable, where there's been a pricing or listing error, where we can't verify your payment or delivery details, or where we reasonably suspect fraud. If we cancel, we'll refund you in full.

Prices are in Australian dollars and include GST where applicable. Shipping is charged separately and shown at checkout before you pay.

If a product is listed at an obviously incorrect price, we'll contact you before processing and you can confirm at the correct price or cancel for a full refund.

5. Personalised orders and your responsibility

Personalised mats are made to order, individually, for you.

You're responsible for the accuracy of everything you enter at checkout, including spelling, names, colour selections, font choices and your delivery address. We print exactly what you provide, and production starts as soon as your order comes through.

We can't remake or refund a mat because of details you entered incorrectly, and any reprint in those circumstances is at your cost.

If your mat arrives and it doesn't match what you entered, that's on us and we'll remake it at no cost to you. See our returns policy for how to let us know.

Nothing in this clause affects your rights under the Australian Consumer Law.

6. Logos and artwork you supply to us

If you supply us with a logo, image, name, slogan or other material to be printed on a product, you confirm that you own it or have permission to use it, and that printing it won't infringe anyone else's rights.

You give us permission to reproduce that material for the purpose of making and supplying your order, and to keep a copy on file so we can fulfil repeat orders.

You agree to cover us for any claim brought against us by a third party because of material you supplied.

We may decline to print material we consider offensive, unlawful or likely to infringe someone else's rights.

7. Payment

We accept the payment methods shown at checkout. Payment is processed by third party providers, and we never see or store your full card details.

We can't be held responsible for delays in payment clearance, and we don't begin production or dispatch until payment has cleared.

8. Shipping, returns and cancellations

Our shipping timeframes, delivery terms and Authority to Leave arrangements are set out in our shipping policy.

Our returns, exchanges and refunds terms are set out in our returns policy.

Both policies form part of these terms.

Once your order is confirmed we can't accept cancellations, because production starts immediately. If something has gone wrong with your order, our returns policy explains what to do.

9. Consumer guarantees and our liability

Our products come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms limits or removes those rights.

To the extent the law allows, and apart from those guarantees, our total liability to you for any claim connected with a product or with this website is limited to replacing the product, resupplying it, or refunding what you paid for it.

To the extent the law allows, we're not liable for indirect or consequential loss, including loss of profit, loss of opportunity or loss of data.

10. Your indemnity to us

You agree to cover us for loss or costs we reasonably incur as a direct result of you breaching these terms, supplying us with material you didn't have the right to use, or using this website unlawfully.

This doesn't apply to loss caused by our own negligence, our breach of these terms, or anything we're not permitted to exclude under the Australian Consumer Law.

11. Intellectual property

All designs, illustrations, artwork, photographs, images, text, logos and website content belong to us and remain ours at all times. Josephine designs all of it herself.

You may not reproduce, republish, distribute, adapt or commercially use any of it without our written permission. Buying a product gives you the product, not the design on it.

Our mats are for personal, family, classroom or centre use. They're not licensed for resale, reproduction, or use in a commercial product or service without a trade or licensing agreement with us.

We take infringement of our designs seriously and will act on it.

12. Photos of your order

We share behind the scenes content, and images of items in production or completed often appear on our website, social media and marketing.

If you'd prefer your order not to be photographed or shared, tell us when you order and we'll make sure it isn't.

If you tag us or send us photos of your mats in use, we may reshare them with credit. Tell us if you'd rather we didn't, and we'll take it down.

13. Our social media channels

We welcome comments, questions and feedback shared respectfully.

Please don't repost our images without permission. Anything reposted from our website or social channels must credit @wonderiumworld.

We may hide comments or block accounts that engage in bullying, harassment, spam or abuse of other people in our community.

14. Discount codes and creator codes

From time to time we share discount codes, including codes through the creators and partners we work with.

Unless the code says otherwise: one code per order, codes can't be combined with each other or with other promotions, they don't apply to gift cards, and they have no cash value.

Codes are for personal use by the people they're shared with. They aren't for resale, and they aren't to be listed on coupon or deal aggregator sites.

We can change, pause or withdraw a code at any time, and we can cancel an order or refuse a code where it's been used in a way it wasn't meant to be, including bulk use, resale, or codes obtained from somewhere they weren't shared.

If a code doesn't work at checkout, email us before you order rather than after. We're not able to apply a discount retrospectively.

15. Privacy

We handle your personal information in line with our privacy policy, which forms part of these terms. It explains what we collect, why we collect it, who we share it with, and how you can access or correct it.

16. Links to other websites

Our site may link to other websites we don't control. We're not responsible for their content, their products or their privacy practices.

17. Events outside our control

We're not liable for delays or failures caused by events beyond our reasonable control, including courier delays and disruptions, supplier or equipment failure, natural disasters, power or internet outages, industrial action, and government restrictions.

If something like this affects your order, we'll tell you and work out the best way forward with you.

18. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place your order is the version that applies to your order.

19. General

If any part of these terms is found to be unenforceable, the rest continues to apply.

These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that state.
